Terms and Conditions.
1. Introduction
These Terms and Conditions (“Terms”) apply to the website https://empowhersociety.global and to all transactions or interactions concerning our online content, events or services provided by ECS EmpowHer Cannabis Society e.V. (“ECS”, “we”, “us”, “our”).Scope clarification – membership: These Terms govern your use of the website itself. To become an official member of the association you must submit a separate membership application and receive acceptance pursuant to the ECS statutes. The corresponding application form—available in print and, once launched, as a digital form—will be provided separately and will contain its own contractual declarations (e.g. fee schedule, revocation information). Additional contracts such as the membership by-laws, fee schedule, or event-specific terms prevail over these Terms in the event of conflict.
2. Binding effect
By accessing, registering with or otherwise using this site, you confirm that you have read, understood and agree to be bound by these Terms. In certain cases, we may request an explicit click-wrap acceptance.
3. Electronic communication
You consent to receive all contracts, notices and disclosures from us electronically, either on the website or via e-mail, and acknowledge that these satisfy any “in-writing” requirement of applicable law.
4. Intellectual property
All content on the site (text, graphics, logos, code, databases, etc.) is protected by copyright and related rights owned by ECS or its licensors. Except as mandated by compulsory law (e.g. quotation right), you may not copy, distribute, modify, decompile, monetise or otherwise exploit any part of the site without our prior written permission.

You may forward our newsletter in electronic form to persons who might be interested.

Please submit inventions, business proposals or other confidential ideas only after we have signed a non-disclosure or IP-assignment agreement. Otherwise, you grant ECS a worldwide, irrevocable, royalty-free license to use such submissions in any medium.
9. Termination or suspension
We may modify, suspend or discontinue the site (or parts thereof) at any time. We accept no liability for resulting loss of data, features or access.
10. Warranties and liability
The site is provided “as is”. To the extent permitted by law we disclaim all warranties—express or implied—regarding accuracy, availability or fitness for purpose. ECS is liable only for intent and gross negligence and—except for injury to life, body or health—limited to foreseeable damages typical for this kind of contract. Our aggregate liability is capped at the total amount you paid to us for the product, service or membership that gave rise to the claim.

Our processing of personal data is explained in the Privacy Policy and Cookie Policy, which form part of these Terms.
12. Export control / legal compliance
Access from jurisdictions where the site’s content, products or services are unlawful is prohibited. You must comply with German and EU export regulations.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
14. Breaches
If you breach these Terms we may, among other measures, suspend access, block your IP, notify your ISP or pursue legal remedies.
15. Indemnification
You will indemnify and hold ECS harmless from claims or damages arising out of your violation of these Terms or of third-party rights.
16. Waiver
Our failure to enforce any provision shall not constitute a waiver of that or any other provision.
17. Language
These Terms are published in German and English. In case of discrepancies, the German version (Allgemeine Geschäftsbedingungen) shall prevail.
18. Entire agreement
These Terms, together with the Privacy Policy, Cookie Policy and any additional contract expressly referenced herein, constitute the entire agreement between you and ECS regarding use of the site.
19. Updates
We may amend these Terms from time to time. The revision date at the top indicates the latest version. Continued use of the site after changes are posted constitutes acceptance of the revised Terms.
20. Choice of law & jurisdiction
These Terms are governed by German law, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. Exclusive place of jurisdiction is Berlin, Germany, unless a mandatory consumer forum applies.If any provision is held invalid, the remainder remains in force. The invalid provision will be replaced by a valid one that most closely reflects the economic intent.
